Spanish Conveyancing Fees
Our professional fees are based on the time we spend dealing with the matter and will be charged at the hourly rate of £250 plus VAT. The value of the property can also be a factor when providing a fee estimate. We will always provide a cost estimate at the beginning of each matter, based on the circumstances of the transaction.
The fees and disbursements below assume a smooth transaction, a re-sale urban property, with a maximum value of 295,000€, mortgage-free, where the Seller is an individual (rather, than say, a Company) and the Buyer is also an individual. The Buyer does not require a mortgage to purchase the property. It also assumes that there are no unforeseen issues including (but not limited to) problems with the title that require rectification and uncooperative parties to the transaction.
BUYING A SPANISH PROPERTY
From £3,250 plus VAT
In addition to our fees, the following disbursements are usually payable:
Notary fees (700-1,000 €), Land Registry Fees (350-600 €), Spanish equivalent of stamp duty (this is dependent on the location of the property but in most areas of Spain is at least 8% of the value of the property; our agent’s fees to deal with matters in Spain such as payment of taxes and registration (700-900 €), searches (300 €) and plusvalía tax (the local Town Hall calculate this amount) if not paid for by the Seller.
Disbursements are costs related to your matter that are payable to third parties. Please note that the above list is not limited and other disbursements may be payable depending on the nature of the case. The cost of the disbursements is dependent on many different factors e.g. the value of the property, number of pages in a Spanish Transfer document, the location of the property etc…Our fees may increase if, for example:-
- the legal title is defective
- planning permission is not available or was never obtained
- the Seller refuses to provide crucial documentation
- The Seller/Sellers legal representative is uncooperative

What services are included
- Liaising with the Seller/Estate Agent/Seller’s legal representative
- Where necessary negotiating the terms of the Contract
- Requesting legal documentation relating to the property.
- Examining all of the documentation supplied to us and highlighting any problems identified.
- Carrying out necessary searches of the property
- Preparing a full report setting out the results of our enquiries and our recommendations concerning the purchase generally.
- Organising the Notary appointment and arranging for all parties to attend.
- Organising payment of the Notary Public and Land Registry fees together with the corresponding purchase taxes.
- Arranging the registration of your Title Deeds with the Spanish Land Registry
How long will my house purchase take?
How long it will take from your offer being accepted until you can complete your house purchase will depend on a number of factors e.g., the cooperation of the Seller party and their legal representative to respond to our queries and requests for information. Assuming a smooth transaction the process can take between 6-8 weeks.

SELLING A SPANISH PROPERTY
From £3,250 plus VAT
In addition to our fees, the following disbursements are usually payable:
Plusvalía tax (the local Town Hall calculate this amount), our agent’s fees to deal with matters in Spain such as payment of taxes, attending the Spanish Notary with you to complete the sale (700-900 €), Spanish Capital Gains Tax (if you are a non-Spanish resident the buyer will have to withhold 3% of the sale price on account of your potential Capital Gains Tax liability).
Disbursements are costs related to your matter that are payable to third parties.
Our fees may increase if, for example
- The legal title is defective
- Planning permission is not available or was never obtained
- You do not have documentation legally required by the Buyer
- The Buyer/buyer’s legal representative is uncooperative

What services are included
- Liaise with the Estate Agent (if applicable) and the Buyer's lawyer to negotiate the terms of the contract and documentation required for completion
- Organise the Notary appointment and arrange for all parties to attend
How long will my house sale take?
How long it will take from accepting the offer until you can complete your house sale will depend on a number of factors e.g., the availability of the documentation legally required by the Buyer, whether either party needs to make arrangements to fly to Spain to complete, the cooperation of the Buyer/ their legal representative. Assuming a smooth transaction the process can take between 6-8 weeks.
BUYING OR SELLING A SPANISH PROPERTY WITH A SPANISH MORTGAGE
Our fees
Assuming the property value does not exceed 295,000 € our fees to deal with the Spanish Lender will be in the region of £600 plus VAT. Please note that our basic conveyancing fees (listed above) will be payable in addition to this.
What services are included
- We will liaise with the Spanish Lender and provide documentation they require
- We will explain the terms of the mortgage to you
